This privacy statement explains how SoPact handles personal data collected during regular business (sales, marketing, and support) and how data are processed in its products and services. SoPact participates in the EU-U.S. Privacy Shield Framework and is retained by the American Arbitration Association/International Centre for Dispute Resolution, GDPR, and CCPA regulations, including The California Privacy Rights Act (CPRA) extension.

SOPACT PLATFORMS & PRODUCTS

SoPact provides an advanced cloud platform and consulting services for Non-profits, Membership organizations, Corporations, Research Companies, Nonprofits, foundations, Impact Investment Funds, Government Agencies, and Universities. The platforms and products provided are Enterprise-level SaaS models accessed using a modern browser via the Internet. SoPacts platforms & products are self-service, whereby the end-users are solely responsible for what data to collect and from whom. Survey respondents may use mobile devices to complete a survey.

All customer data collected using the software are stored in a single secure data center; data do not “float” around in the cloud.

Surveys may be distributed in numerous ways: via email, a web link, or an offline mobile app. Surveys may require a password or other authentication by the respondent.

DATA COLLECTED DURING NORMAL BUSINESS TRANSACTIONS.

(UNRELATED TO THE SOFTWARE)

For the www.sopact.com site: SoPact collects and analyzes visitors' aggregate information, including the domain name, visited pages, referring URLs, and other publicly available information. We use this information to improve our website and services and customize our pages' content for each customer. Cookies may be used to customize content delivered to website visitors.

SoPact does not sell or make available specific information about our customers or their clients to anyone except as requested by a valid court order or otherwise required by law. We maintain a database of user information used only for internal purposes such as technical support, and marketing-related activities and to notify customers of changes or enhancements to the services. SoPact uses secure services for online credit card payment transactions and does not record or store credit card information on its site or servers.

If you have provided your consent, we process personal information about you such as name, organization, email, phone number, interest in the social space, and organization type. Sopact uses this information to:

  • Deliver the resources and information you have requested online.
  • Send direct email marketing communications about our solutions, events, and related resources that may interest you.
  • Use cookies and other data collection technologies to help you navigate our website or technical solutions, personalize and provide a more convenient experience to you.
  • You may withdraw your consent at any time by clicking the “unsubscribe” link in the email communications we send to you. 

You have six basic rights under privacy and data protection laws related to the data we process about you.

  • Request access to the personal information we process about you
  • Request that we correct inaccurate or incomplete personal information about you
  • Request deletion of personal information about you
  • Right to Non-Discrimination
  • Request restrictions, temporarily or permanently, on our processing of some or all personal information about you;
  • Opt-out to our use of personal information about you 

DATA COLLECTED BY CUSTOMERS

For this section, customers are end-users with valid SoPact accounts. Customers own and control all information they input into the SoPact Platforms (“Data”) and any information generated from that Data. Data may include personal information depending on how the Customer chooses to use the software. Customers manage all Data, and the users who create, manage, distribute, or report the Data.

SoPact treats all Data as highly confidential and does not classify or represent it because only the customer knows what it’s collecting. In other words, SoPact provides the services, and Customers use them as they wish. All Data are safeguarded using industry best security practices that prevent unlawful disclosure.

SoPact will only process Data for the sole purpose of providing the software and services. Customers must ensure that they follow applicable laws when distributing surveys. This includes following applicable laws when collecting personal and health information, preventing unsolicited emails from being sent, and deleting personal information when no longer required.

SoPact will only transfer Data to a third party with the customer's permission. In other words, there is no onward transfer.

Customers can disable SoPact support from accessing their accounts. But doing so may hinder timely responses and the quality of support.

COMPLAINTS AND INQUIRIES

SoPact is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC), and individuals have a right to contact the FTC regarding services provided by SoPact.

If you are an EU citizen and have questions about your personal information that may have been collected in a SoPact survey, please contact the entity that created or sent you the survey. SoPact is not responsible for any Data collected and only processes Data as controlled by the customer. If the survey creator is unresponsive to your inquiry, please contact SoPact Support.

General inquiries regarding this policy, or any complaints regarding surveys unresolved by the survey creator, may be sent to SoPact Support by clicking on “Contact Us” or by calling the number listed on the main www.SoPact.com website. There is no charge for this inquiry.

SoPact has a team of legal and technical staff to maintain compliance with this policy. For legal inquiries, please contact support@sopact.com.

When you visit or log in to our website, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. We (or service providers on our behalf) may then send communications and marketing to these email or home addresses. SOPACT EU DATA SILO

SoPact offers customers wishing to process all data in Europe the EU Data Silo option. The basis for this option is to keep all collected Data in an EU data center and provide all support. Please contact your SoPact account executive for more details.
